This SMS/Texting Policy describes the terms that apply when you opt in to receive SMS or text messages from K Mods LLC, doing business as K. Mods Racing (“K. Mods,” “K. Mods Racing,” “we,” “us,” or “our”).

You must be 18 years of age or older to opt in to or use the K Mods LLC SMS/text messaging service.

By affirmatively opting in to receive SMS/text messages from K Mods LLC, you confirm that you are at least 18 years old, are authorized to use the mobile telephone number provided, and agree to this SMS/Texting Policy.

1. SMS Consent

You may opt in to receive SMS/text messages from K Mods LLC by providing your mobile telephone number and affirmatively consenting through an available opt-in method, such as an unchecked checkbox on a website form, signup form, or another consent mechanism presented by K Mods LLC.

Providing your telephone number alone does not constitute consent to receive optional marketing or promotional SMS/text messages.

Consent to receive marketing SMS/text messages is not a condition of purchasing any goods or services from K Mods LLC.

  • You are the subscriber or customary user of the mobile telephone number provided, or you are otherwise authorized to provide consent for that number.
  • You have read and agree to this SMS/Texting Policy.

Individuals under 18 years of age may not enroll in or use the K Mods LLC SMS/text messaging service.

6. Opting Out

You may opt out of SMS/text communications at any time by replying STOP to a message from K Mods LLC.

After submitting an opt-out request, you may receive a final confirmation message indicating that your request has been processed and that you have been unsubscribed.

After your opt-out request has been processed, we will not send additional marketing SMS/text messages to that mobile number unless you subsequently provide consent and opt in again.

Consent to receive automated marketing messages is not a condition of purchasing any goods or services from K Mods LLC.

9. Mobile Number Responsibilities

You are responsible for providing a valid mobile telephone number that you are authorized to use.

By opting in, you represent that you are the subscriber, customary user, or otherwise authorized user of the mobile number provided.

If your mobile number changes, is disconnected, or is reassigned to another person, you should reply STOP or otherwise notify K Mods LLC before discontinuing use of that number.

10. Mobile Information and Privacy

K Mods LLC respects the privacy of information collected through our SMS/text messaging service.

K Mods LLC does not sell, rent, or share your mobile phone number, SMS opt-in information, or SMS consent with third parties or affiliates for their own marketing or promotional purposes.

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.

We may disclose mobile information to service providers that assist us in operating and delivering our SMS/text messaging service, including telecommunications providers, messaging platforms, aggregators, customer service providers, and technology vendors, solely as necessary to provide those services on our behalf.

Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the text messaging services necessary to deliver SMS communications.

11. Carrier Disclaimer

Wireless carriers are not responsible for delayed or undelivered messages.

Delivery of SMS/text messages depends on effective transmission by your wireless carrier, network provider, messaging providers, and other systems outside the reasonable control of K Mods LLC.

SMS/text messaging may not be available through all wireless carriers, devices, plans, or geographic locations.

K Mods LLC does not guarantee that every SMS/text message will be successfully delivered.

12. No Purchase Required

Consent to receive marketing or promotional SMS/text messages from K Mods LLC is not a condition of purchase.

You may purchase products or use eligible K Mods LLC services without enrolling in our marketing SMS/text messaging service.

Declining to receive marketing SMS/text messages will not affect your ability to make a purchase.

13. Transactional and Customer Service Communications

When permitted by applicable law, we may communicate with you regarding transactions or customer service matters using contact information you have provided.

Providing a mobile telephone number for an order, shipping purpose, customer service inquiry, product inquiry, or other transaction does not, by itself, constitute consent to receive marketing SMS/text messages where separate consent is required.

14. Changes to the SMS/Texting Service

K Mods LLC may modify, suspend, or discontinue all or part of its SMS/text messaging service at any time, subject to applicable law.

We may update this SMS/Texting Policy periodically to reflect changes to our messaging practices, technology, services, or applicable legal requirements.

Any revised policy will be posted with an updated effective date. Where required by applicable law, additional notice will be provided.

15. Related Policies

Use of the K Mods LLC SMS/text messaging service is also subject to our Privacy Policy and Terms of Service.

Our Privacy Policy provides additional information regarding how K Mods LLC collects, processes, uses, discloses, retains, and protects personal information, including mobile telephone numbers and SMS consent information.

If there is a conflict concerning the collection, processing, or use of personal information, our Privacy Policy will control to the extent applicable.
