Welcome to K. Mods Racing, operated by K Mods LLC (“K. Mods,” “K. Mods Racing,” “we,” “us,” or “our”).

By accessing or using our website, purchasing products, submitting forms, communicating with us, or using our services, you agree to these Terms of Service. If you do not agree to these Terms, please do not use our website or services.

1. General

K Mods LLC reserves the right to update, modify, or replace these Terms of Service at any time.

Changes will become effective when posted to our website with an updated effective date.

Your continued use of our website following an update constitutes acceptance of the revised Terms to the extent permitted by applicable law.

2. Products, Pricing & Information

We make reasonable efforts to ensure that product descriptions, specifications, pricing, availability, fitment information, photographs, and other product information are accurate and current.

However, errors, omissions, supplier changes, manufacturing revisions, and inventory synchronization delays may occur.

We reserve the right to:

• Correct errors or inaccuracies.
• Update product information or specifications.
• Change prices without prior notice.
• Limit product quantities.
• Discontinue products.
• Correct inventory or availability information.
• Cancel or refund orders affected by pricing, inventory, availability, or listing errors.

Product colors, finishes, packaging, hardware, specifications, and appearance may vary due to display settings, manufacturing variations, lighting, photography, supplier revisions, or product updates.

Where a product is supplied or fulfilled by a third-party vendor, product information may be based in part on information provided by that supplier.

3. Product Availability & Vendor Inventory

Some products offered by K. Mods are stocked directly by us, while others may be sourced, stocked, fulfilled, or shipped by approved manufacturers, distributors, suppliers, or fulfillment partners, including suppliers connected through Shopify Collective.

Inventory for certain vendor-fulfilled products may be electronically synchronized between K. Mods and the applicable supplier.

We make reasonable efforts to maintain accurate inventory information. However, supplier inventory can change between synchronization updates.

As a result, a vendor-fulfilled product may occasionally appear available on our website when the supplier no longer has sufficient inventory to fulfill the order.

Vendor-fulfilled products are subject to final inventory and fulfillment confirmation by the applicable supplier.

The display of a product as available, submission of an order, receipt of an order confirmation, or processing of payment does not guarantee final availability of a vendor-fulfilled product.

If a supplier informs K. Mods that an ordered product is unavailable or cannot be fulfilled, K. Mods may cancel the affected item or order and issue the applicable refund.

If the entire order cannot be fulfilled because of product unavailability, K. Mods will refund the amount paid for the unavailable merchandise and applicable shipping charges associated with the unfulfilled order.

If only part of an order cannot be fulfilled, K. Mods may continue fulfillment of the available products and refund the unavailable products, together with any shipping amount specifically attributable to the unfulfilled portion when applicable.

K. Mods does not intentionally accept orders for products known to be unavailable. These provisions address situations in which supplier inventory changes before updated availability is reflected on our website.

Nothing in this section limits any consumer right or remedy that cannot legally be waived.

4. Vendor-Fulfilled Orders

Some products purchased through K. Mods may be shipped directly to customers by approved suppliers, manufacturers, distributors, or other fulfillment partners.

Regardless of which approved supplier stocks, fulfills, or ships an order, your purchase through kmodsracing.com is with K. Mods, and K. Mods remains your point of contact regarding your order.

Customers should contact K. Mods directly regarding:

• Returns
• Exchanges
• Refunds
• Fitment questions
• Incorrect products
• Damaged or defective products
• Missing components
• Shipping or tracking concerns
• Product availability
• Other order-related issues

Please do not return merchandise directly to a supplier or manufacturer unless specifically instructed by K. Mods.

Certain vendor-fulfilled products may be subject to product-specific or supplier-specific processing, return, cancellation, or warranty requirements as disclosed on the applicable product page or in our policies.

5. Orders

Submitting an order does not guarantee acceptance or fulfillment.

K Mods LLC reserves the right, subject to applicable law, to:

• Accept, decline, or cancel an order.
• Limit quantities purchased.
• Request additional information or verification.
• Cancel orders suspected of fraud or unauthorized payment activity.
• Cancel orders associated with resale abuse or other suspicious activity.
• Cancel an order when a product becomes unavailable.
• Correct fulfillment, inventory, pricing, or listing errors.

An automated order confirmation acknowledges that we received your order. It does not necessarily constitute confirmation that every item has been finally allocated or accepted for fulfillment.

If we cancel a paid order or item, the applicable amount will be refunded to the original payment method.

6. Payment

Payment is generally due in full when an order is placed.

Orders may be held until payment has been successfully authorized or processed. Additional verification may be required for certain transactions.

Customers are responsible for providing accurate and current billing and payment information.

Payment authorization or collection does not override the product availability provisions contained in these Terms.

7. Refund Transactions

When a refund is owed under our policies, K. Mods will generally issue the applicable refund to the original payment method.

Depending on the payment platform, payment processor, transaction structure, and circumstances of the refund, merchandise and shipping refunds may be processed as separate transactions.

Customers may therefore receive:

• A separate merchandise refund.
• A separate shipping refund.
• Multiple refund notifications.

Separate processing or notifications do not reduce the total applicable refund owed to the customer.

Once K. Mods submits a refund, the amount of time required for the funds to appear in the customer’s account is determined by the customer’s bank, card issuer, payment provider, or other financial institution.

8. Shipping & Delivery

Shipping and delivery estimates are provided for convenience and are not guaranteed unless expressly stated otherwise.

Delivery times may be affected by:

• Carrier delays
• Weather
• Holidays
• Inventory availability
• Supplier processing
• Manufacturing schedules
• Customs
• Incorrect or incomplete addresses
• Other circumstances outside our reasonable control

Customers are responsible for providing a complete and accurate shipping address when placing an order.

If you discover an address error, contact us as quickly as possible. We cannot guarantee that an address can be changed after an order has entered fulfillment or has been transferred to a shipping carrier.

Some products may be fulfilled or shipped directly by one of our authorized suppliers, manufacturers, distributors, or fulfillment partners.

Orders containing multiple products may be shipped in separate packages and may originate from different locations.

Tracking information is provided when available. Carrier tracking may take time to update after a shipping label is created.

The creation of a shipping label does not necessarily mean that the carrier has physically received the package.

If a shipment is lost, damaged, misdelivered, or otherwise experiences a delivery issue, please contact K. Mods so we can investigate the shipment and determine the appropriate next steps.

9. Returns, Exchanges & Cancellations

Please review our current Refund & Return Policy before purchasing.

Unless otherwise stated, eligible products may be subject to our standard return period. Certain supplier-fulfilled products may have different return windows or requirements as disclosed in our Refund & Return Policy or on the applicable product page.

Certain products may be:

• Custom-built
• Made-to-order
• Special-order
• Electrical or electronic
• Installed
• Programmed
• Modified
• Otherwise ineligible for return or exchange

Eligibility for a return, exchange, cancellation, or refund is determined according to the Refund & Return Policy and any applicable product-specific terms.

If K. Mods or an approved supplier is unable to fulfill an order because the product is unavailable, that situation is treated as an unfulfilled order rather than a voluntary customer cancellation, and the applicable refund provisions will apply.

10. Product Compatibility & Fitment

Customers are responsible for reviewing product compatibility and fitment information before purchasing.

Fitment information is provided as a guide and may vary because of factors including:

• Model year
• Manufacturing changes
• Existing vehicle modifications
• Aftermarket components
• Wheel or tire configurations
• Suspension modifications
• Motor or controller configurations
• Battery or electrical configurations
• Other modifications or aftermarket components

If you are uncertain whether a product will work with your vehicle, e-moto, e-bike, motorcycle, or build, contact us before ordering.

Providing information or recommendations about potential compatibility does not replace proper inspection, measurement, installation, manufacturer guidance, or professional judgment.

11. Installation & Modification

Many products sold by K Mods LLC are performance components and may require mechanical, electrical, fabrication, programming, or technical experience.

Improper installation, modification, configuration, maintenance, or use can cause product failure, vehicle damage, battery or electrical damage, fire, electrical hazards, serious injury, or death.

Professional installation by a qualified technician is strongly recommended when appropriate.

K Mods LLC is not responsible for damage resulting from improper installation, unauthorized modification, misuse, improper configuration, failure to follow manufacturer instructions, or use outside a product’s intended purpose, to the extent permitted by applicable law.

Customers are responsible for ensuring that installed components are properly configured and compatible with other components in their vehicle or build.

12. Performance & Off-Road Products

Certain products offered by K Mods LLC may be intended for racing, competition, off-road, closed-course, or other specialized applications.

Products that increase vehicle speed, power, voltage, current, braking performance, suspension characteristics, or other performance characteristics may affect the:

• Legality
• Safety
• Reliability
• Manufacturer warranty
• Insurance coverage
• Roadworthiness

of a vehicle or build.

Customers are responsible for determining whether the purchase, installation, configuration, and use of a product complies with applicable federal, state, and local laws and regulations.

K Mods LLC does not represent that every performance product sold through our website is legal for operation on public streets, roads, sidewalks, trails, or other public areas in every jurisdiction.

13. SMS/Text Messaging Terms

Age Requirement

You must be 18 years of age or older to enroll in or use the K Mods LLC SMS/text messaging service.

By opting in to receive SMS/text messages from K Mods LLC, you represent and confirm that you are at least 18 years old and are authorized to provide consent for the mobile number submitted.

By voluntarily providing your mobile phone number and affirmatively opting in to receive SMS/text messages from K Mods LLC, you consent to receive text messages from K Mods LLC at the mobile number you provided.

Depending on the specific opt-in and your interaction with us, messages may include:

• Customer support and service communications
• Responses to product, fitment, or build inquiries
• Order confirmations and updates
• Shipping and tracking notifications
• Account or transactional notifications
• Abandoned-cart reminders
• Product announcements
• Promotions, discounts, special offers, and other marketing communications where you have consented to receive them

Message frequency varies. Message and data rates may apply.

Consent to receive marketing SMS/text messages is not a condition of purchasing any goods or services from K Mods LLC.

Where permitted by applicable law, messages may be sent using automated technology.

SMS Opt-In and Consent

Providing a telephone number to K Mods LLC does not, by itself, constitute consent to receive optional or marketing SMS messages.

Where consent is required, you must affirmatively opt in through the applicable signup form, checkbox, keyword, or other consent mechanism.

Your consent applies only to the types of communications described at the time you opt in.

You represent that you are the subscriber or customary user of the mobile number you provide and that you are authorized to provide consent for messages to that number.

Opting Out

You may opt out of SMS/text communications at any time by replying STOP to a message from us.

After submitting an opt-out request, you may receive a final text message confirming that your request has been processed. We will not send additional marketing text messages to that number unless you subsequently provide consent again.

If your mobile number changes, is disconnected, or is reassigned to another person, you agree to opt out or notify us before discontinuing use of the number.

Mobile Information & Privacy

Our collection and use of information associated with SMS/text communications is governed by our Privacy Policy.

K Mods LLC does not sell or rent mobile phone numbers, SMS opt-in information, or SMS consent for third-party marketing purposes.

Mobile information will not be shared with third parties or affiliates for their own marketing or promotional purposes.

We may disclose mobile information to service providers that assist us in operating our messaging program, including telecommunications providers, messaging platforms, aggregators, customer-service providers, and technology vendors, solely as necessary to provide those services on our behalf.

Text messaging originator opt-in data and consent will not be shared with third parties for their own marketing purposes, excluding aggregators and providers of the text messaging services necessary to deliver SMS communications.

Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages.

Delivery of SMS/text messages is subject to effective transmission by your wireless carrier and/or network operator and is outside K Mods LLC’s control.

SMS availability may vary by carrier, device, and geographic location.

Changes to SMS Terms

We may modify or terminate our SMS/text messaging program or these SMS terms as permitted by applicable law.

Material changes will be reflected in these Terms of Service or otherwise communicated when required by applicable law.

14. Communications

When you contact K Mods LLC through our website, email, forms, checkout, or other support channels, you authorize us to respond using the contact information you provide to the extent permitted by applicable law.

Providing contact information for an order, customer-service request, product inquiry, build request, or other transaction does not constitute consent to receive marketing SMS/text messages where separate consent is required.

Marketing emails and SMS/text messages that require consent will be sent only in accordance with applicable opt-in and legal requirements.

You may withdraw consent or unsubscribe from marketing communications using the opt-out methods provided in those communications.

SMS/text messaging is additionally governed by the SMS/Text Messaging Terms above and our Privacy Policy.

15. Limitation of Liability

To the fullest extent permitted by applicable law, K Mods LLC shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or relating to use of our website, services, or products.

To the extent permitted by applicable law, our aggregate liability relating to a particular product or transaction will not exceed the amount paid to K Mods LLC for the product or transaction giving rise to the claim.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

16. Warranties

Product warranties vary by manufacturer, supplier, and product.

Where a manufacturer or supplier warranty applies, warranty coverage may be subject to that party’s terms, exclusions, procedures, and eligibility requirements.

Except as expressly provided by K Mods LLC or required by applicable law, we do not provide additional warranties beyond those specifically stated for a product.

Installation, modification, racing use, misuse, improper electrical configuration, improper programming, or operation outside manufacturer specifications may affect warranty eligibility.

For products purchased through K. Mods, customers should contact K. Mods first regarding warranty concerns unless otherwise instructed.

17. Intellectual Property

Unless otherwise indicated, website content owned by K Mods LLC, including original text, graphics, logos, branding, photographs, videos, product descriptions, page designs, and other original materials, may not be copied, reproduced, distributed, republished, or commercially exploited without permission.

Third-party trademarks, product names, images, logos, and other intellectual property remain the property of their respective owners.

The use of third-party product names or trademarks on our website does not necessarily indicate sponsorship, endorsement, affiliation, or authorization unless expressly stated.

18. User Conduct

You agree not to:

• Use our website for unlawful or fraudulent purposes.
• Attempt unauthorized access to our website, accounts, servers, or systems.
• Interfere with the operation or security of our website.
• Submit malicious software, automated attacks, or harmful content.

However, the use of a third-party fulfillment supplier does not change the customer’s obligation to contact K. Mods regarding an order purchased through kmodsracing.com.

Your use of our services is also subject to our Privacy Policy, which describes how K Mods LLC collects, uses, processes, and discloses personal information.

The Privacy Policy also contains additional information regarding SMS/text messaging data, mobile information, opt-in information, consent records, cookies, advertising, privacy rights, and communication preferences.

21. Governing Law

These Terms of Service are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent otherwise required by applicable law.

Any dispute arising from or relating to these Terms, our services, or transactions with K Mods LLC will be handled in accordance with applicable law and any legally enforceable dispute-resolution requirements.

22. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law.

The invalidity or unenforceability of one provision will not affect the validity or enforceability of the remaining provisions.

23. No Waiver

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

24. Entire Agreement

These Terms of Service, together with our Privacy Policy, Shipping Policy, Refund & Return Policy, and any product-specific terms or other policies expressly incorporated by reference, constitute the agreement between you and K Mods LLC regarding your use of the applicable services and transactions with us.

If a product page contains specific terms applicable to a particular product, including disclosed preorder, special-order, supplier-specific, or return requirements, those terms may also apply to that product, subject to applicable law.
